Terms & SMS Terms

These terms govern use of RingMender, a DBA of Herman Stone Inc. By using our website or services, you agree to these terms. Participating businesses may also have their own terms for the services they provide.

The service

RingMender provides managed missed-call recovery for participating businesses. When an eligible call is missed, busy, or received after hours, RingMender may send a business-identified text to understand the caller's service need and route the inquiry back to that business. We do not guarantee that a call, text, lead, appointment, or sale will be completed.

Participating-business responsibilities

Participating businesses must provide accurate identity and contact information, maintain any required caller disclosures and permissions, honor opt-outs, use recovered information only for the customer's inquiry, and comply with applicable communications, privacy, and consumer-protection laws.

Acceptable use

You may not use the service for unlawful, deceptive, abusive, harassing, fraudulent, or unsolicited messaging; to collect sensitive information unnecessarily; or to interfere with the service or another person's rights.

Fees and pilots

Business-client fees, pilot credits, usage charges, start dates, and cancellation terms are described in the applicable order or written agreement. Unless that agreement says otherwise, third-party carrier and messaging usage may be billed separately.

Availability and liability

The service is provided on an "as available" basis. To the extent permitted by law, Herman Stone Inc. disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or lost-profit damages. Any direct liability is limited to the amount paid for the affected service during the three months before the event giving rise to the claim.
